Traditional Litigation and the Non-Traditional Alternative Dispute Resolution Essay There are many ways to handle a dispute. Many people chose to use the traditional litigation system, which are lawsuit being brought forth in the courts and some people choose alternative routes which may not always be involved in the court. The formal definition of traditional litigation is â€Å"the process of bringing, maintaining, and defending a lawsuit. This is also called judicial dispute resolution because courts are used to decide the case† (Cheeseman, 2010). Alternative Dispute Resolution is defined as â€Å"methods of resolving disputes other than litigation† (Cheeseman, 2010). Alternative Dispute Resolution By far the most common form of ADR is arbitration, however other types of ADR exist such as negotiation, mediation, conciliation, mini-trial, fact-finding, and the use of a judicial referee. â€Å"Negotiation is a procedure whereby the parties to a dispute engage in negotiations to try to reach a voluntary settlement of their dispute† (Cheeseman, 2010). Negotiations can go on for an extended amount of time to ensure that both parties are satisfied. Mediation is another type of ADR in which all parties involved in the issue select and agreed to use neutral third party that assumes the role of an intermediary that between both parties. The sole purpose of this intermediary is to facilitate a settlement between the parties. If an accord is reached by the disputing parties, then a settlement agreement is written and executed by the parties. Conciliation is a method of ADR frequently used when the parties involve do not wish to face each other in a confrontational venue. In this method an interested party known as a conciliator assists the party’s dispute to reach a settlement. The conciliator facilitates this process by the communicating offers and counter-offers of settlement between the two parties. Traditional Litigation System The traditional litigation system is where two parties (defendant and plaintiff) go forward in a court of law to solve a certain issue that they have with each other. In a traditional legal system the contents of the case publicity is not considered because adverse publicity is what is associated with litigation. The expenses in the traditional litigation system can become expensive and costly; this is the reason that some people chose Alternative Dispute Resolutions. Differences between Systems The two legal systems have some major differences. In the ADR system the resolution is usually less formal and less intimidating than in the traditional legal system. The resolutions are quicker and less expensive, the dispute is usually heard by an arbitrator or mediator and at the end of the â€Å"trail† the respondents will receive an opinion which can be filed with the court to become binding and turned into a judgment. The traditional legal system or trials are usually a more formal and slower process. The trials are more expensive because of the length of the trials. Trials are often heard before a judge and the judgments are binding through the court systems. Conclusion A person has to choose to decide which of the legal systems work best for them. It is important for a claimant to compare and contrast the impact that either of the systems would have on their particular situation.

What is Love? Love: What is it? Love, what is it? To many people love means many things. To others, to love is to place their happiness in one another. Others love can be how they feel about that special someone. I'm not talking about the fatherly love or that motherly love. I'm talking about the love that you feel towards someone. That special someone that you could possibly spend the rest of your life with. Webster defines love as a strong feeling of attraction resulting from sexual desire; enthusiasm or fondness. But to me love is not just a feeling, but it is the way that you treat that special someone that you care for. Treating them so kindly so they'll know you care and love them. Love in my eyes, is making that sacrifice for someone, knowing that you might regret it sooner or later. Love is how you make another person feel when you are in their presence. Love is the laughter that you share, the time you spend, and the relationship that you build with that special someone. Many people show or express their love for someone in many and different ways. For instance, there was an ancient Egyptian Poem that captivated my attention. While I was reading the poem it made me realize how more people view love the same way as I do. The poem is named "Love, how I'd love to slip down to the pond." In the poem there were lines that helped me realize that love is not what you say, it is what you do. And in the poem there was a line that stood out far from the rest. It said, "Just for you I'd wear my new Memphis swimsuit, made of sheer linen, fit for a queen- Come see how it looks in the water". Not caring about how she looks to others or how foolish she might feel, she entices her mate with a swimsuit that when w... ...itten by Chung Tzu there is a pome numbered 22 in the text. Part of it reads: Of fair girls the prettiest Gave me a red flute. The flush of that red flute Is pleasure at the girl's beauty. She has Been in the pastures and brought for me rush-wool, Very beautiful and rare. It is not you that are beautiful; But you were given by a lovely girl. In my opinion the moral of the poem is not to cherish what is given to you, but cherish the thought and sincerity of the person. Material items can be lost, broken, or even stolen. But when you see it as an action of ones emotion, the thought of that item ant the person who gave it to you will live on forever. But, they definitely realize they need the shot, and don't want to have to cancel their trip at the last minute because they didn't get it. They often find themselves making a long trip to a regional medical center because they didn't plan ahead.

Most people think of communism as a bad thing. Karl Marx would disagree. He formed the basic ideas of communism in his writings. He argued that communism was the eventual government that formed out of many unsuccessful governments. Many modern communists either use his ideas or use parts of his ideas to form their own. Karl Marx is the true father of communism. Marx was born in Trier, Prussia on May 5, 1818 (Beales). His family was Jewish, but his father converted the family to Protestantism when Marx was born. When he was seventeen, he went to the University of Bonn to earn his degree in law (Kreis). He left and attended the University of Berlin where he studied philosophy and earned his doctorate in 1841. His first job was†¦show more content†¦He and Engels joined the communist league in the spring of 1847. They were then asked to write The Communist Manifesto by the league (Engels). It was published in 1848 and became their most famous work. In it Marx stated that history consisted of many class struggles between upper and middle classes. He believed that this would eventually lead to a revolution and then a classless society, or communism (Beales). When the February Revolution broke out in 1848, he was expelled from Brussels and, after being invited back by the French government, moved back to Paris. He and some leaders of the Communist League traveled to Germany (Engels). In Cologne, he started another radical paper, which was quickly suppressed. He then fled to London, where he would spend the rest of his life (Kreis). In the 1850s, Marx was highly dependant on Engels for income. During this time, he was occupied with writing the three volumes of Capital. The first volume was not published until 1867 and the other two were not completely finished, although Engels had them published after Marx died. Marx was slow to publish his works because of his devotion to the First International, which was an international socialist group. When the Paris Commune of 1871 occurred, he was inspired to write one of his most famous pro-communism pamphlets, The Civil War in France (Kreis).
